Commissioner’s Instruction No. 15 - Appointment of former public service officers ceasing employment with statutory offices

This Commissioner’s instruction sets out the minimal procedural requirements to be followed to appoint former public service officers to the public service – where an officer has a legislative entitlement to be appointed to a public service office on their cessation with the statutory office. As a minimum such persons are entitled to be appointed at the same level of classification, status or salary as their former public service office. It replaces Public Sector Commissioner’s Circular 2009-35 – Re-employment of public service officers employed in statutory offices.

The Commissioner’s instruction is supported by guidelines. The guidelines are not intended to be prescriptive in nature but have been prepared to assist in the practical application of the Commissioner’s instruction.
